  • Services: Includes financial advisory, portfolio management, stock market-related services, and any other services provided by EquiMinions.
  • Agreement: This refers to these Terms and Conditions, the Privacy Policy, and any other related agreements made between the user and EquiMinions.
  1. Eligibility

By using our services, you represent that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding contract as per The Indian Contract Act, 1872.
  • You are not barred by any applicable laws or regulations from using our services.
  1. Scope of Services

EquiMinions offers the following services:

  • Financial Advisory Services: Offering advice on stock markets, investments, wealth management, and portfolio strategies.
  • Portfolio Management Services: Managing clients’ investment portfolios based on their financial goals and risk profiles.
  • Educational Seminars/Workshops: Organizing events, webinars, or workshops related to stock markets and financial education.

EquiMinions reserves the right to modify, suspend, or discontinue any of our services at any time without prior notice.

  1. Client Obligations

By using our services, you agree to:

  • Provide Accurate Information: You will provide complete, accurate, and up-to-date information when interacting with us.
  • Comply with Laws: You will comply with all applicable local, state, national, and international laws and regulations.
  • Financial Responsibility: You are solely responsible for all investments, transactions, or decisions made based on our advisory services.
  • Use of Services: You will use our services only for lawful purposes and in accordance with these Terms.
  1. Investment Risk

Investments in financial markets, including equities and derivatives, carry inherent risks. By using our services, you acknowledge and agree that:

  • Risk of Loss: All investments carry risk, including potential loss of capital. Past performance is not indicative of future results.
  • No Guarantees: EquiMinions does not guarantee any profits, returns, or specific financial outcomes from the services offered.
  • Independent Decision-Making: Clients are advised to independently evaluate all financial advice provided and make their own investment decisions. We are not responsible for any decisions or actions taken by you.
  1. Fees and Payments
  • Service Fees: You agree to pay all fees for the services provided by EquiMinions as agreed upon in the engagement letter or fee schedule.
  • Payment Terms: Payments must be made as per the agreed-upon terms. Late payments may attract penalties as outlined in the fee schedule.
  • Non-Refundable: Fees paid for financial advisory services are non-refundable unless otherwise stated in writing.

 

  1. Intellectual Property
  • Ownership: All content, materials, trademarks, logos, and proprietary information related to EquiMinions are owned by or licensed to EquiMinions and are protected by applicable intellectual property laws.
  • Restrictions: You are prohibited from reproducing, distributing, or using any of the materials for commercial purposes without prior written consent from EquiMinions.
  1. Confidentiality
  • Client Information: EquiMinions will maintain the confidentiality of all personal and financial information provided by clients as outlined in our Privacy Policy.
  • Non-Disclosure: You agree not to disclose any proprietary information or advice received from EquiMinions to third parties without prior written consent.
  1. Limitation of Liability

To the maximum extent permitted by law, EquiMinions will not be liable for:

  • Direct, Indirect, or Consequential Losses: This includes any loss of profit, investment, data, or other damage that arises from the use or inability to use our services.
  • Third-Party Services: We are not responsible for any services, content, or products provided by third-party service providers.

EquiMinions’ total liability for any claims arising out of or related to these Terms shall not exceed the fees paid by the client for the specific service during the 6 months preceding the claim.

  1. Indemnification

You agree to indemnify, defend, and hold harmless EquiMinions, its directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses arising out of your violation of these Terms, applicable laws, or any unauthorized use of our services.

  1. Termination
  • Client Termination: You may terminate your use of our services at any time by providing us with written notice.
  • EquiMinions Termination: We reserve the right to terminate your access to our services without notice if you breach these Terms or engage in unlawful activities.
  • Consequences of Termination: Upon termination, your right to use our services ceases, and any outstanding payments will become immediately due.
  1. Force Majeure

EquiMinions will not be held liable for any delays, interruptions, or failures in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, wars, strikes, internet failures, or governmental actions.

  1. Dispute Resolution

Any disputes arising from or related to these Terms will be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration will take place in [City, State] and be conducted in English. The decision of the arbitrator(s) will be final and binding on both parties.

  1. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts in New Delhi, India.
